What does it take to get a search warrant to seize a computer?

What does it really take for police to seize a computer? I have someone claiming I have been harrassing them over the internet, but I really havent. One of my friends emailed this accuser and told the accuser to leave me alone. Do the police have the authority to seize my computer even though the accuser doesnt have proof of any harrassment from me besides the emails from my friend which were sent from a differant computer? I know the police would have to obtain a warrant first, but what evidence do they need to actually obtain a warrant?

No they can't. I have only heard of computers being seized if a person is accused of a murder, stalking, or sexual abuse of a minor, or an tempt of it. Dont worry. Youre going to be okay, and keep your computer. Computer harrassment is not a serious crime, if it even is a crime. Take Care, and block this fool from contacting you. Problem solved!

Reply:They just need just cause. They can find that if they wanted to anytime, anywhere.





Odds are unless child pornogrophy is involved or laundering money or death threats they would never touch your computer, Sounds like a highschool fight more than a matter for the law.
Reply:The police do need sufficient evidence to obtain a warrant, and they have to get it from the courts, just like an arrest warrant, or a warrant to search your property. If you have nothing to hide, then you can simply let them look at your computer. They aren't going to care if it's filled with a stash of porn sites, but obviously they'd check through them all to make sure that they aren't illegal in any way.





the police can't waltz into a court room and ask a judge for a warrant just because somebody has claimed that you've been harrassing them. The person who has claimed harrassment needs to provide evidence, such as a full transcript of the conversation before they can start doing stuff like that, and they'd probably end up seizing both computers to compare the data and prove it anyway, which would eliminate the possibility they just typed it up to look like an IM conversation had taken place.
